1. Overview
These terms ("Terms") govern access to and use of MMI Theory and related services, APIs, and content (collectively, the "Service") provided by McBride Machine Intelligence ("MMI", "we", "us"). By accessing or using the Service, you agree to these Terms.
2. Definitions
"You" means the individual or entity using the Service. "Agent" means any software, model, automation, bot, or autonomous or semi-autonomous system that you deploy or use to access the Service, including systems acting on your behalf. "Controller" means the person or entity that configures, authorizes, or benefits from an Agent's use.
3. Agent Use and Controller Responsibility
If you use an Agent to access the Service, you are the Controller and are fully responsible for the Agent's actions, outputs, and decisions, including requests made, costs incurred, and compliance with law and these Terms. You must ensure your Agents follow rate limits, authentication requirements, and all published usage policies.

4. Prohibited and High-Risk Uses
You may not use the Service (including via an Agent) to:
- violate any law, regulation, or third-party rights;
- attempt to gain unauthorized access or probe, scan, or test vulnerabilities;
- perform actions that could cause physical harm, property damage, or safety-critical failures;
- make or execute medical, legal, financial, or other high-stakes decisions without qualified human review;
- generate or execute malware, exploits, or abusive automation;
- scrape or harvest personal data or attempt re-identification.
MMI may suspend or terminate access for suspected violations or risk to the Service, users, or third parties.
5. Availability and Output Disclaimers
The Service may change over time. Availability, latency, and outputs are provided "as is" and may be affected by maintenance, outages, network conditions, or third-party infrastructure. Where we publish machine-readable specifications, schemas, or determinism guarantees, they apply only as explicitly stated for the identified version and corpus. You are responsible for validating outputs before relying on them.
6. Fees, Rate Limits, and Billing Responsibility
You are responsible for all fees and charges incurred through your use of the Service, including those incurred by Agents under your control. Published pricing and rate limits may be incorporated by reference.
7. Intellectual Property
MMI and its licensors retain all rights in the Service, including software, documentation, and content, except where explicitly stated otherwise.
8. Privacy
Do not submit sensitive personal information unless explicitly requested by an MMI process designed to handle it. We may process operational logs for security, abuse prevention, and reliability.
9. Limitation of Liability
To the maximum extent permitted by law, MMI will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. MMI's total liability for any claim relating to the Service will not exceed the amounts paid by you to MMI for the Service in the three (3) months preceding the event giving rise to the claim, or USD $100 if no fees were paid.
10. Indemnification
You agree to defend, indemnify, and hold harmless MMI from claims, damages, liabilities, and expenses arising from your use of the Service, including use by Agents under your control, and any violation of these Terms or applicable law.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction and venue in those courts.
12. Changes
We may update these Terms by posting a revised version on this page. Continued use of the Service after an update constitutes acceptance of the revised Terms.
